1996 LAWS OF MARYLAND

(1994 Replacement Volume and 1995 Supplement)

(As enacted By Chapter 598 of the Acts of the General Assembly of 1995)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Health Occupations

17-101.

(a)     In this title the following words have the meanings indicated.

(b)     (1) "ALCOHOL AND DRUG THERAPY COUNSELING" MEANS APPLYING
THEORIES, METHODS, AND TECHNIQUES OF COUNSELING, PSYCHOTHERAPY, AND
THE
STUDY OF ADDICTIONS TO INDIVIDUALS, FAMILIES, ORGANIZATIONS, GROUPS,
SCHOOLS, OR COMMUNITIES WHO ARE EXPERIENCING COGNITIVE, AFFECTIVE,

BEHAVIORAL, OR PSYCHOSOCIAL DYSFUNCTION AS A DIRECT OR INDIRECT RESULT
OF DRUG AND ALCOHOL ABUSE, DEPENDENCY, OR ADDICTION
ASSISTING AN
INDIVIDUAL, FAMILY, OR GROUP THROUGH THE CLIENT-COUNSELOR
RELATIONSHIP:                                                                 

(1) TO DEVELOP UNDERSTANDING OF INTRAPERSONAL AND
INTERPERSONAL SUBSTANCE ABUSE PROBLEMS;

(2) TO DEFINE GOALS RELATING TO SUBSTANCE ABUSE:

(3) TO MAKE DECISIONS RELATING TO SUBSTANCE ABUSE:

(4) TO PLAN A COURSE OF ACTION REFLECTING THE NEEDS,
INTERESTS, AND ABILITIES OF THE INDIVIDUAL FAMILY, OR GROUP RELATING TO
SUBSTANCE ABUSE; AND

(5) TO USE INFORMATIONAL AND COMMUNITY SUBSTANCE ABUSE
RESOURCES RELATING TO PERSONAL SOCIAL EMOTIONAL EDUCATIONAL AND
VOCATIONAL DEVELOPMENT AND ADJUSTMENT.

(2) "ALCOHOL AND DRUG THERAPY" DOES NOT INCLUDE THE
EMPLOYMENT RELATED ACTIVITIES AND
SERVICES OF AN INDIVIDUAL WHO IS
EMPLOYED BY AN ALCOHOL AND DRUG ABUSE PROGRAM OR FACILITY THAT IS
ACCREDITED BY THE JOINT COMMI
SSION ON ACCREDITATION OF HEALTH CARE
ORGANIZATIONS OR THAT IS CERTIFIED UNDER TITLE 8, SUBTITLE 4 OF THE
HEALTH
- GENERAL ARTICLE

(C) "Appraisal" means:

(1)     Selecting, administering, scoring, and interpreting instruments designed
to assess an individual's aptitudes, attitudes, abilities, achievements, interests, and
personal characteristics; and

(2)     Using nonstandardized methods and techniques for understanding
human behavior in relation to coping with, adapting to, or changing life situations.
