Ch. 576

1996 LAWS OF MARYLAND

COUNSELOR-DRUG AND ALCOHOL ALCOHOL AND DRUG THERAPIST, CERTIFIED
ASSOCIATE COUNSELOR-DRUG AND ALCOHOL ALCOHOL AND DRUG THERAPIST, OR
CERTIFIED ASSOCIATE SUPERVISED COUNSELOR-DRUG AND ALCOHOL ALCOHOL
AND DRUG THERAPIST; or

(3) Use the title "C.P.C." [or], "C.P.C."-"M.F.T.", "C.P.C.-D.A.T."
"C.P.C.-A.D". "C.C.-D.A.T." "C.A.C.-A.D". OR "C.A.C.-D.A.T." "C.S.C.-A.D.", the words
"certified professional counselor" or "licensed professional counselor-marriage and
family therapist", or the words "certified counselor" or "licensed marriage and family
therapist" with the intent to represent that the person practices professional counseling
or marriage and family therapy, OR THE WORDS "CERTIFIED PROFESSIONAL
COUNSELOR-DRUG AND ALCOHOL ALCOHOL AND DRUG THERAPIST", "CERTIFIED
ASSOCIATE COUNSELOR-DRUG AND ALCOHOL ALCOHOL AND DRUG THERAPIST',
"CERTIFIED ASSOCIATE SUPERVISED COUNSELOR-DRUG AND ALCOHOL ALCOHOL
AND DRUG THERAPIST' WITH THE INTENT TO REPRESENT THAT THE PERSON
PRACTICES DRUG AND ALCOHOL ALCOHOL AND DRUG THERAPY COUNSELING.

SECTION 2. AND BE IT FURTHER ENACTED, That, notwithstanding whether
the services are provided within the scope of practice of a certified professional
counselor-drug and alcohol therapist, a certified counselor-drug and alcohol therapist, or
a certified associate counselor-drug and alcohol therapist, nothing in this Act may be
construed to require a nonprofit health service plan, insurer, health maintenance
organization, or person acting as a third party administrator to reimburse a certified
professional counselor-drug and alcohol therapist, a certified counselor-drug and alcohol
therapist, or a certified associate counselor-drug and alcohol therapist.

SECTION 2. 3. AND BE IT FURTHER ENACTED, That the Laws of Maryland
read as follows:

Article - Health Occupations

18-102.

Unless the individual uses as a title or describes the services the individual provides
by use of the words "psychological", "psychologist", or "psychology", this title does not
limit:

(1) The right of an individual to practice a health occupation that the
individual is licensed, certified, or otherwise authorized to practice under this article:

(2) The right of an individual to provide vocational rehabilitation services as
authorized under Title 9, Subtitle 6 of the Labor and Employment Article: OR

[(3) The employment related activities and services of an individual who is
employed by an alcohol and drug abuse program or facility that is accredited by the Joint
Commission on Accreditation of Health Care Organizations or that is certified under
Title 8, Subtitle 4 of the Health - General Article; or

(4)] (3) The nonprofit activities and services of a bona fide religious
organization that is exempt from taxation under § 501(c)(3) of the Internal Revenue
Code.
