(1) THE EMPLOYEE'S CURRENT OR PROSPECTIVE EMPLOYER AT THE
NURSING FACILITY;

(2) THE DEPARTMENT OF HEALTH AND MENTAL HYGIENE; AND

(1) THE ADULT DEPENDENT CARE PROGRAM SEEKING TO HIRE THE
POTENTIAL ELIGIBLE EMPLOYEE; AND

(3) (2) THE POTENTIAL ELIGIBLE EMPLOYEE.
19-1805. 19-1806.

(A) IF THE ADULT DEPENDENT CARE PROGRAM REQUESTS A PRIVATE
AGENCY BACKGROUND CHECK THE PRIVATE AGENCY SHALL ISSUE A STATEMENT
OF ITS FINDINGS TO THE POTENTIAL ELIGIBLE EMPLOYEE AND THE ADULT
DEPENDENT CARE PROGRAM; AND

(B) THE POTENTIAL ELIGIBLE EMPLOYEE SHALL HAVE AN OPPORTUNITY TO
CONTEST THE FINDINGS.

(A)     (1) THE DEPARTMENT SHALL CONDUCT THE CRIMINAL BACKGROUND
INVESTIGATION
HISTORY RECORDS CHECK AND ISSUE THE PRINTED STATEMENT
PROVIDED FOR UNDER THIS SUBTITLE.

(2)      THE DEPARTMENT SHALL UPDATE AN INITIAL INVESTIGATION
CRIMINAL HISTORY RECORDS CHECK AND ISSUE A REVISED PRINTED STATEMENT,
LISTING ANY OF THE CONVICTIONS, OR PENDING CHARGES, OR OFFENSES
OCCURRING IN THE STATE DURING THE TIME OF EMPLOYMENT AFTER THE DATE
OF THE INITIAL CRIMINAL BACKGROUND PRINTED STATEMENT HISTORY RECORDS
CHECK

(3)      THE DEPARTMENT SHALL ADOPT REGULATIONS REQUIRING
EMPLOYERS TO VERIFY PERIODICALLY THE CONTINUING EMPLOYMENT OF AN
EMPLOYEE.

(B)     (1) THE DEPARTMENT SHALL PROVIDE A PRINTED STATEMENT OF THE
APPLICANTS POTENTIAL ELIGIBLE EMPLOYEE'S STATE CRIMINAL RECORD TO THE
RECIPIENTS OF THE ACKNOWLEDGMENTS SPECIFIED IN § 19-1804(B) § 19-1805(B) OF
THIS SUBTITLE

(2) THE DEPARTMENT SHALL:

(I) RECORD ON A PRINTED STATEMENT THE EXISTENCE OF A
CONVICTION OR PENDING CHARGE REPORTED IN THE CRIMINAL HISTORY RECORD
INFORMATION RECEIVED FROM THE FEDERAL BUREAU OF INVESTIGATION
IDENTIFICATION DIVISION; AND

(II) DISTRIBUTE THE PRINTED STATEMENT IN ACCORDANCE WITH
FEDERAL LAW AND REGULATIONS ON DISSEMINATION OF FEDERAL BUREAU OF

INVESTIGATION IDENTIFICATION RECORDS.
