(House Bill 458)

AN ACT concerning

Unemployment Insurance - Employing Unit - Custom Poultry Work

FOR the purpose of establishing, for purposes of unemployment compensation law, that
under certain circumstances, a certain crew leader is an employing unit for certain
individuals who perform certain custom poultry work; establishing, for purposes of
unemployment compensation law, that under certain circumstances, the person to
whom the crew leader provides an individual who performs certain custom poultry
work is an employing unit for the individual; providing for the application of this
Act; and generally relating to the employing unit, for purposes of unemployment
compensation law, of an individual who performs certain custom poultry work.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Labor and Employment

8-207.

(d) (1) The crew leader is the employing unit for an individual employed in
agricultural work who is not an employee of another employing unit if:

(i) the crew leader holds a valid certificate of registration under the
federal Migrant and Seasonal Agricultural Worker Protection Act; [or]

(ii) substantially all of the individuals maintain or operate tractors,
mechanized harvesting or cropdusting equipment, or any other mechanized equipment
that the crew leader provides; OR

(III) THE INDIVIDUAL:

1.       PERFORMS CUSTOM POULTRY WORK, INCLUDING
HARVESTING, BREEDING, DEBEAKING, SEXING, AND HEALTH SERVICES; AND

2.       IS NOT REQUIRED TO BE AWAY FROM THE INDIVIDUAL'S
PERMANENT PLACE OF RESIDENCE OTHER THAN DURING NORMAL WORKING
HOURS.
