Ch. 206

1996 LAWS OF MARYLAND

DESIGNATED IN THE TITLE INSURANCE AGENCY CONTRACT BETWEEN THE
INSURER AND THE AGENT. THE ON-SITE REVIEW shall include a review of the title
insurance agent's or agency's policy blank inventory and processing operations.

(l) (1) A title insurance agent or title insurance broker shall notify the
Commissioner. AND ANY INSURER WITH WHOM THE TITLE INSURANCE AGENT OR
TITLE INSURANCE BROKER HOLDS AN APPOINTMENT, if an individual licensed under
this subtitle leaves the employment of or ends an association with the title insurance
agent or title insurance broker.

(b) Subject to this section, the Commissioner may issue a special restricted
certificate of qualification to an attorney at law of the State TO ACT AS A TITLE
INSURANCE AGENT OR TITLE INSURANCE BROKER.

10-126.

(b) Subject to the hearing provisions of Title 2 of this article, the Commissioner
may [suspend] DENY, REFUSE TO RENEW, SUSPEND, or revoke the certificate of
qualification of a partnership or corporation [for any violation of this subtitle by] IF an
agent, broker, director, officer, [or] partner, OWNER. OR EMPLOYEE of the partnership
or corporation HAS:

(1) VIOLATED ANY PROVISION OF THIS SUBTITLE;

(2) BEEN CONVICTED OF A FELONY, A CRIME OF MORAL TURPITUDE,
OR ANY CRIMINAL OFFENSE INVOLVING DISHONESTY OR BREACH OF TRUST; OR

(3) HAS ANY PROFESSIONAL LICENSE SUSPENDED OR REVOKED FOR A
FRAUDULENT OR DISHONEST PRACTICE.

SECTION 3. AND BE IT FURTHER ENACTED, That Section(s) 168A(d)
through (o), respectively, of Article 48A - Insurance Code of the Annotated Code of
Maryland be renumbered to be Section(s) 168A(c) through (n), respectively.

SECTION 4. AND BE IT FURTHER ENACTED, That Section(s) 10-121(b)
through (1), respectively, of Article - Insurance of the Annotated Code of Maryland (as
enacted by Chapters 36 and 635 of the Acts of the General Assembly of 1995) be
renumbered to be Section(s) 10-121(a) through (k), respectively.

SECTION 5. AND BE IT FURTHER ENACTED, That Sections 1 and 3 of this
Act shall take effect October 1, 1996.

SECTION 6. AND BE IT FURTHER ENACTED, That Sections 2 and 4 of this
Act shall take effect October 1, 1997.
