Ch. 10                                      1996 LAWS OF MARYLAND

(a)     (1) In this section the following words have the meanings indicated.

(2)     "Fund" means the Protective Body Armor Fund established under this
section.

(3)     "Local law enforcement agency" means the police department of any
county or incorporated city or town, including Baltimore City, within this State.

(4)     "Protective body armor" means a vest or similar article designed to be
worn on the body for protection against blunt force trauma associated with the impact of
a firearm projectile and manufactured of bullet resistant fabric that conforms to National
Institute of Justice (NIJ) Standard 0101.03 (or the current edition) and V-50 ballistic
testing requirements.

[(5) "Superintendent" means the Superintendent of the Department of State
Police.]

(b)     A Protective Body Armor Fund is established to assist local law enforcement
agencies in:

(1)     Acquiring protective body armor for each police officer of the unit; and

(2)     Replacing protective body armor at least every 10 years, or sooner if
testing indicates a need.

(c)     (1) The [Superintendent] SECRETARY shall administer the Fund in
accordance with this section and other applicable law.

(2)     The Fund shall consist of any moneys appropriated in the State budget.

(3)     Payments out of the Fund shall be made to a local law enforcement
agency by the State Treasurer as authorized by the [Superintendent] SECRETARY.

(4)     State funds provided under this section may be used by local law
enforcement agencies only to purchase or replace protective body armor.

(d)     (1) The [Superintendent] SECRETARY shall establish application
procedures for local law enforcement agencies to apply for aid from the Fund.

(2) A local law enforcement agency applying for aid from the Fund shall
provide the following information to the [Superintendent] SECRETARY:

(i) The number of violent crime incidents committed within the
jurisdiction of the local law enforcement agency for the last 2 years;

(ii) The current number of sworn officers;
