Article 88B - Department of State Police

12A.

(a) (8) "Qualifying crime of violence" means:

(i) A violation of Article 27, [§ 35A] § 35C of the Code that involves
sexual abuse;

(i) (3) (ii) The Crime Laboratory and each analyst performing DNA analyses
at the Crime Laboratory shall undergo, at regular intervals not exceeding 180 days,
external proficiency testing, including at least one external blind test, by a DNA
proficiency testing program that meets the standards issued:

1. Under § 1003 of the federal DNA Identification Act of
[1993] 1994; or

21.

Employment of any employee shall terminate upon his death, retirement,
resignation or discharge. Retirement shall occur in accordance with the applicable
provisions of §§ 31 through 37 of this article or [§§ 49 through 62 of this article] THE
STATE PERSONNEL AND PENSIONS ARTICLE and, except as to the Secretary, shall be
mandatory as provided in § 31 (a) of this article or [§ 53 (a) (3) of this article] § 24-401(C)
OF THE STATE PERSONNEL AND PENSIONS ARTICLE. Resignation of an employee shall
not be valid until accepted by the Secretary, but acceptance shall not be withheld unless
proceedings for discharge are contemplated or pending. An employee, other than a
probationary employee, may be discharged only in accordance with the provisions of the
State Personnel and Pensions Article that govern classified service employees.

23A.

(a) If a disability resulted from an injury or illness sustained in the performance of
an officer's work, the Secretary may grant work-related administrative leave to
[law-enforcement] LAW ENFORCEMENT officers in [his department] THE
DEPARTMENT who are temporarily disabled in the performance of their work. The
work-related administrative leave remains in effect until the State Police officer is
returned to duty or is retired by reason of those injuries. However, the work-related
administrative leave may not exceed 2 years and may not extend beyond 2 years from the
illness or injury date.
