REVISOR'S NOTE: Items (1) and (2) of this section are standard language added
for clarity and to conform to the practice of the Commissioner.

Item (3) of this section is new language derived without substantive change
from former Art. 48A, § 52.

In item (3)(v) of this section, the reference to the "insurance supervisory
official" is substituted for the former reference to the "public official having
supervision of insurance" to conform to item (3)(iv) of this section.

In item (3)(vii) of this section, the reference to a certificate "evidencing" a
deposit is substituted for the former reference to a certificate "of" deposit for
clarity.

4-109. ISSUANCE OR DISAPPROVAL OF INITIAL CERTIFICATE OF AUTHORITY:

(A)     IN GENERAL.

WITHIN A REASONABLE TIME AFTER THE FILING OF A COMPLETED
APPLICATION FOR AN INITIAL CERTIFICATE OF AUTHORITY, THE COMMISSIONER
SHALL:

(1)      ISSUE AN APPROPRIATE CERTIFICATE OF AUTHORITY; OR

(2)      DISAPPROVE THE APPLICATION AND STATE THE GROUNDS FOR
DISAPPROVAL.

(B)     LIMITED CERTIFICATE OF AUTHORITY.

ON REQUEST OF AN INSURER, THE COMMISSIONER MAY ISSUE A CERTIFICATE
OF AUTHORITY LIMITED TO A PARTICULAR TYPE OF INSURANCE OR INSURANCE
COVERAGE WITHIN THE SCOPE OF A KIND OF INSURANCE.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 48A, § 53(1) and the second sentence of (2).

In subsection (b) of this section, the former phrase "as defined in Subtitle 4 of
this article" is deleted as surplusage.
