1995 LAWS OF MARYLAND

(1)      CARRY OUT THIS ARTICLE;

(2)      ESTABLISH, MAINTAIN, AND ADMINISTER RESERVES UNDER TITLE 3,
SUBTITLE 2A OF THE COURTS ARTICLE; AND

(3)      REGULATE THE SOLICITATION BY A DOMESTIC STOCK INSURER OR
OTHER PERSON OF PROXIES, CONSENTS, AND AUTHORIZATIONS WITH RESPECT TO
EQUITY SECURITIES OF THE DOMESTIC STOCK INSURER.

(B) COPIES.

(1)      THE COMMISSIONER SHALL:

(I)      COMPILE AND KEEP IN THE OFFICE OF THE COMMISSIONER A
SET OF CURRENT REGULATIONS ADOPTED UNDER THIS ARTICLE; AND

(II)     MAKE A COPY OF THE REGULATIONS FOR ANYONE WHO ASKS
FOR ONE.

(2)     THE COMMISSIONER MAY SET A FEE TO COVER THE COST OF
MAKING AND MAILING A COPY OF THE CURRENT REGULATIONS.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 48A, § 26(3) and the first and third sentences of (1).

In the introductory language of subsection (a) of this section, the former word
"reasonable", which modified "regulations", is deleted as surplusage.

In subsection (a)(1) of this section, the reference to regulations to "carry out
this article" is substituted for the former reference to regulations "necessary
for or as an aid to effectuation of any provision of this article" for brevity and
to conform to similar provisions in other revised articles of the Code.

In subsection (b)(1) of this section, the former phrase "on file" is deleted as
surplusage.

Also in subsection (b)(1) of this section, the former phrase "as a public
record" is deleted as unnecessary since regulations, by law, must be published
and are thereby available to the public. See Title 10, Subtitle 1 of the State
Government Article.

The Insurance Article Review Committee notes, for consideration by the
General Assembly, that subsection (b)(2) of this section is revised to authorize
the Commissioner to set a fee for making and mailing a copy of the
regulations. In practice, if the Administration receives a request for only a few
pages of regulations, it will provide photocopies of the regulations at $1 a
page. See § 2-112(a)(16) of this subtitle. But see SG § 10-621 on the general
provisions for fees for public records.

As to the substitution of "regulations" for the former references to "rules and
regulations", see the General Revisor's Note to this article.
