H.B. 230

(B) (1) EXCEPT AS PROVIDED IN PARAGRAPHS (2) AND (3) OF THIS
SUBSECTION, A CHILD SEX OFFENDER SHALL REGISTER WITH THE MARYLAND
STATE POLICE DEPARTMENT WITHIN 7 DAYS 48 HOURS AFTER THE ENTRY OF A
CONVICTION DESCRIBED IN SUBSECTION (A)(2) SUBSECTION (A)(7) OF THIS SECTION.

(2) IF THE CHILD SEX OFFENDER IS INCARCERATED AS A RESULT OF A
CONVICTION DESCRIBED IN SUBSECTION (A)(2) SUBSECTION (A)(7) OF THIS SECTION,
THE CHILD SEX OFFENDER SHALL REGISTER WITH THE MARYLAND STATE POLICE
DEPARTMENT WITHIN 7 DAYS 48 HOURS AFTER BEING RELEASED FROM
INCARCERATION.

(3) IF THE CHILD SEX OFFENDER IS A RESIDENT OF ANOTHER STATE,
THE CHILD SEX OFFENDER SHALL REGISTER WITH THE MARYLAND STATE POLICE
DEPARTMENT WITHIN 10 DAYS
48 HOURS AFTER THE EARLIER OF;

(I) ESTABLISHING A RESIDENCE IN THIS STATE; OR

(II) APPLYING FOR A DRIVER'S LICENSE IN THIS STATE.

(C) (1) ON THE EARLIER DATE OF THE CHILD SEX OFFENDER'S RELEASE
FROM INCARCERATION, GRANT OF PROBATION, OR GRANT OF A SUSPENDED
SENTENCE, THE SUPERVISING AUTHORITY SHALL;

(I) NOTIFY THE CHILD SEX OFFENDER IN WRITING OF THE
REGISTRATION REQUIREMENTS OF THIS SECTION;

(II) OBTAIN A STATEMENT SIGNED BY THE CHILD SEX OFFENDER
ACKNOWLEDGING THE RECEIPT OF THE WRITTEN NOTICE; AND

(III) RETAIN A COPY OF THE SIGNED ACKNOWLEDGMENT,

(2) IF THE SUPERVISING AUTHORITY ACCEPTS SUPERVISION OF AND
HAS LEGAL AUTHORITY OVER A CHILD SEX OFFENDER FROM ANOTHER STATE
UNDER THE TERMS AND CONDITIONS OF THE INTERSTATE COMPACT AGREEMENT
ESTABLISHED UNDER ARTICLE 11,
§ 4-801 OR §§ 4-1201 THROUGH 4-1211 OF THE CODE
UNIFORM OUT OF STATE PAROLEE SUPERVISION ACT OR THE INTERSTA
TE
CORRECTIONS COMPACT, THE SUPERVISING AUTHORITY SHALL:

(I) GIVE THE CHILD SEX OFFENDER WRITTEN NOTICE OF THE
REGISTRATION REQUIREMENTS OF THIS SECTION;

(II) OBTAIN A STATEMENT SIGNED BY THE CHILD SEX OFFENDER
ACKNOWLEDGING THE RECEIPT OF THE WRITTEN NOTICE; AND

(III) RETAIN A COPY OF THE SIGNED ACKNOWLEDGMENT.

(D) (1) IF A SEX OFFENDER IS INCARCERATED IN A CORRECTIONAL
INSTITUTION OR OTHER FACILITY UNDER THE JURISDICTION OF THE DEPARTMENT
OR A FACILITY UNDER THE CUSTODY OF THE DEPARTMENT OF HEALTH AND
MENTAL HYGIENE, PRIOR TO RELEASE FROM INCARCERATION THE APPROPRIATE
SUPERVISING AUTHORITY SHALL PROVIDE THE SEX OFFENDER WITH:
