Dear Mr. President:
In accordance with Article II, Section 17 of the Maryland Constitution, I have today
vetoed Senate Bill 455.
This bill clarifies that under the Maryland Fair Distributorship Act repurchases made as
a result of cancellations or nonrenewals of agreements involving special tools, accessories,
display equipment and other similar items must be made at the purchase price paid by the
distributor, less depreciation, or an amount agreed upon by the parties.
House Bill 1135, which was passed by the General Assembly and signed by me on May 9,
1995, accomplishes the same purpose. Therefore, it is not necessary for me to sign Senate
Bill 455.

AN ACT concerning
Maryland Fair Distributorship Act
FOR the purpose of clarifying that a distributor includes a person that distributes certain
specialty custom made products under certain circumstances; providing the terms
for the repurchase of certain merchandise under certain circumstances; protecting a
distributor from cancellation or nonrenewal under certain circumstances; increasing
the amount of time by which a distributor must make a certain notice; providing that
State law applies to certain distributorship agreements; providing for the
construction of this Act; clarifying that certain rights and remedies remain available
to a grantor and a distributor; making the provisions of this Act severable; providing
for the applicability of this Act; and generally relating to wholesale distributorships.
