Ch. 638

(iii) Detention time may be extended in increments of not more than 14
days where the petition charges the child with a delinquent act and where the court finds,
after a subsequent hearing, that extended detention is necessary either:

1. For the protection of the child; or

2. For the protection of the community.

SECTION 3. AND BE IT FURTHER ENACTED, That Section 2 of this Act
shall take effect contingent on the taking effect of Chapter ___ (H.B. 407/S.B. 343) of

the Acts of the General Assembly of 1995, and if Chapter ___ does not become

effective, Section 2 of this Act shall be null and void without the necessity of further
action by the General Assembly.

SECTION 2. 4. AND BE IT FURTHER ENACTED, That this Act is an
emergency measure, is necessary for the immediate preservation of the public health and
safety, has been passed by a yea and nay vote supported by three-fifths of all the members
elected to each of the two Houses of the General Assembly, and, except as provided in
Section 3 of this Act, shall take effect from the date it is enacted.

AN ACT concerning

Statute of Limitations - Breast Implant Product Liability Claims

FOR the purpose of establishing a certain period of limitations for the filing of an action
for damages for an injury or death caused by the effects of a breast implant or
breast implant materials; making this Act inapplicable to certain actions; providing
for the intent of this Act; and generally relating to the period of limitations for filing
an action for damages for an injury or death caused by the effects of a breast
implant or breast implant materials.
