8-204.3.                                                                                                                 

(g) The proposed premises location shall be:

(1)     Primarily within a mixed-use building or structure that contains at least
250,000 total square feet of any combination of retail, service, entertainment, parking,
office, and restaurant uses; and

(2)     In the Old Towson Shopping District within the "Towson Town Center",
which district is located along both sides of the 300, 400, and 500 blocks of York Road and
the unit and 100 blocks of East Chesapeake Avenue.

(h) The proposed premises location shall otherwise comply with the zoning
regulations;

(i) The license, once issued, may not be:

(1)     Transferred to a new location outside the mixed-use building or
structure of original location issuance; or

(2)     Converted to any other class of license.

(j) (1) The license may not be issued for premises in a mixed-use building or
structure if there are 5 alcoholic beverages retail licenses of any class operating within the
same mixed-use building or structure; and

(2) Only 2 licenses may be issued within the same mixed-use building or
structure if there are 2 existing 7-day Class BDR (Deluxe Restaurant) (on-sale) beer,
wine and liquor licenses authorized and issued within the same mixed-use building or
structure.

(k) The total seating capacity for the area dedicated primarily for the purpose of
the consumption of alcoholic beverages may not exceed 15% of the total seating capacity
of the establishment.

(1) Subject to the provisions of subsections (e) and (m) of this section, the hours
during which the privileges conferred by the license may be exercised may not exceed the
hours in which food is offered for sale.
