(19) HAS KNOWINGLY EMPLOYED OR KNOWINGLY CONTINUED TO
EMPLOY AN INDIVIDUAL ACTING IN A FIDUCIARY CAPACITY WHO HAS BEEN
CONVICTED OF A FELONY OR CRIME OF MORAL TURPITUDE WITHIN THE PRECEDING
10 YEARS.
(B) SUBJECT TO THE HEARING PROVISIONS OF TITLE 2 OF THIS ARTICLE, THE
COMMISSIONER MAY SUSPEND OR REVOKE THE CERTIFICATE OF QUALIFICATION
OF A PARTNERSHIP OR CORPORATION FOR ANY VIOLATION OF THIS SUBTITLE BY
AN AGENT, BROKER, DIRECTOR, OFFICER, OR PARTNER OF THE PARTNERSHIP OR
CORPORATION.
[(b)](C) Instead of or in addition to suspending or revoking the certificate of
qualification, the Commissioner may impose on the holder of the certificate of
qualification a penalty of not less than $100 but not exceeding $500 for each violation of
this article.
[(c)](D) Instead of or in addition to suspending or revoking the certificate of
qualification, the Commissioner may require that restitution be made to any citizen who
has suffered financial injury because of the violation of this article.
[(d)](E) If the certificate of qualification is suspended or revoked under this
section, the Commissioner may require the individual to pass an examination and file a
new application before the certificate of qualification is reinstated.

A title insurance agent OR TITLE INSURANCE BROKER that willfully or knowingly
violates § 10-121 of this subtitle is guilty of a misdemeanor and on conviction is subject to
a fine not exceeding $50,000 or imprisonment not exceeding 1 year or both.
SECTION 3. AND BE IT FURTHER ENACTED, That, notwithstanding the
provisions of Section 1 of this Act, a person who is not licensed on or before July 1, 1995,
is not subject to the provisions of Section 1 of this Act and is not required to obtain a
license under Section 1 of this Act until January 1, 1996.
SECTION 2. 4. AND BE IT FURTHER ENACTED, That Sections 1 and 3 of this
Act shall take effect July 1, 1995.
SECTION 5. AND BE IT FURTHER ENACTED, That Section 2 of this Act shall
take effect October 1, 1997.
