SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1995.

AN ACT concerning

Program Open Space Act of 1995

FOR the purpose of altering the purposes of Program Open Space to provide for certain
capital renewal needs; requiring certain moneys received by the State to be
deposited into the Advance Option and Purchase Fund; requiring the Department
of Natural Resources at a certain time to submit certain expenditures and
documentation to the budget committees of the General Assembly, specifying a
certain period within which certain budget committees must provide certain
comments to the Board of Public Works; authorizing the Department and the
Maryland Environmental Trust, with approval by the Board of Public Works, to
acquire certain rights in land from the Department of Transportation subject to a
certain condition and to use State project funds under the Program to contribute
towards or reimburse the Department of Transportation for certain costs;
authorizing the Department to dispose of certain interests in certain properties
acquired after a certain date, subject to certain procedures and approvals; altering
certain procedures concerning a certain allocation to local governing bodies;
authorizing the Department to make a certain reimbursement under a certain
condition; specifying a certain basis for certain acquisition goals developed by local
governing bodies; prohibiting certain projects from receiving funds from a local land
trust grant fund unless certain approvals exist; authorizing the Department, rather
than the Board of Public Works, to make a certain conditional approval concerning
a local land grant fund; authorizing local governing bodies to use all or a certain
portion of a certain annual appropriation for development or capital renewal
projects under certain circumstances; requiring a certain certification concerning
certain excess funds derived from the conversion of certain land; requiring the
Department to submit a certain annual report to the General Assembly; defining a
certain term; and generally relating to Program Open Space.
