Ch. 563                                    1995 LAWS OF MARYLAND

(K) (1) AN. AGREEMENT SHALL BE VOID IF NOT RECORDED IN THE LAND
RECORDS OFFICE OF THE JURISDICTION WITHIN 20 DAYS AFTER THE DAY ON
WHICH THE PARTIES EXECUTE THE AGREEMENT.

(2) WHEN AN AGREEMENT IS RECORDED, THE PARTIES TO THE
AGREEMENT AND THEIR SUCCESSORS IN INTEREST ARE BOUND TO THE
AGREEMENT.

(L) UNLESS TERMINATED UNDER SUBSECTION (I) OF THIS SECTION, THE
PARTIES TO AN AGREEMENT OR THEIR SUCCESSORS IN INTEREST MAY ENFORCE
THE AGREEMENT.

(M) NOTHING IN THIS SECTION MAY BE CONSTRUED TO REQUIRE THE ADOPTION
OF AN ORDINANCE BY A GOVERNING BODY OR TO AUTHORIZE A GOVERNING BODY TO
REQUIRE A PARTY TO ENTER INTO AN AGREEMENT.

SECTION 2. AND BE IT FURTHER ENACTED, That except to the extent
affected by a development rights and responsibilities agreement, this Act is not intended
to otherwise abrogate Maryland common law.

SECTION 3. AND BE IT FURTHER ENACTED, That this subtitle may not
abrogate existing powers, explicit or implied, exercised by a local government to enter
development rights and responsibilities agreements before the effective date of this Act.

SECTION 4. AND BE IT FURTHER ENACTED, That this Act may not
abrogate existing powers, explicit or implied, exercised by district council, county
executive, or planning board of the Maryland-National Capital Park and Planning
Commission, to enter into development rights and responsibilities agreements and
regulatory plan enforcement agreements and related documents before the effective date
of this Act.

SECTION 5. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1995.

Creation of a State Debt - Jewish Historical Society of Maryland - Museum and

Educational Facility

FOR the purpose of authorizing the creation of a State Debt not to exceed $750,000, the
proceeds to be used as a grant to the Jewish Historical Society of Maryland for
certain development or improvement purposes; providing for disbursement of the
loan proceeds, subject to a requirement that the grantee provide and expend a
matching fund; providing that no proceeds of a loan or any matching funds may be
