(A) EXCEPT AS PROVIDED IN SUBSECTION (B) OF THIS SECTION, THE
COMMISSION SHALL TERMINATE AFTER DECEMBER 31, 1996 ON JANUARY 1, 1997.
(B) THE CHAIRMAN OF THE COMMISSION OR A DESIGNEE OF THE CHAIRMAN
MAY REPORT ON THE MISSION STATEMENT TO THE GENERAL ASSEMBLY DURING
THE 1997 SESSION.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
July 1, 1995. It shall remain effective for a period of two years and, at the end of June 30,
1997, with no further action required by the General Assembly, this Act shall be
abrogated and of no further force and effect.

AN ACT concerning
Real Property - Development Rights and Responsibilities Agreements
FOR the purpose of authorizing certain local governments, including certain planning
boards of the Maryland - National Capital Park and Planning Commission, to enter
and amend development rights and responsibilities agreements with certain
persons; authorizing the local governments to establish, by ordinance, certain
procedures and requirements for the consideration, execution, and amendment of
development rights and responsibilities agreements; requiring certain procedures
before entering and amending development rights and responsibilities agreements;
requiring development rights and responsibilities agreements to contain certain
provisions; establishing that under certain conditions a development rights and
responsibilities agreement is void after a certain number of years; authorizing the
parties to a development rights and responsibilities agreement to suspend or
terminate the agreement under certain circumstances; authorizing the local
government to unilaterally suspend or terminate a development rights and
responsibilities agreement under certain circumstances; establishing that certain
laws, rules, regulations, and policies shall govern development rights and
responsibilities agreements under certain circumstances; providing that the
recording of an agreement within a certain number of days has a certain effect;
establishing the rights of parties to enforce a development rights and responsibilities
agreement; defining certain terms; providing for the application of certain provisions
of this Act; providing that this Act is not intended to abrogate certain laws, except
under certain circumstances; providing that this Act is not intended to abrogate
certain powers of certain local governments; and generally relating to development
rights and responsibilities agreements.
BY repealing and reenacting, with amendments,
