SUBTITLE 10. SHORT TITLE.                         

15-1001. SHORT TITLE.

THIS TITLE MAY BE CITED AS THE MARYLAND PUBLIC ETHICS LAW.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 40A, § 1-101.

Article - Education

13-1D-06.

[(e) Members of the EMS Board are "public officials" for the purpose of the
Public Ethics Law under Article 40A of the Code.]

REVISOR'S NOTE: Section 13-1D-06(e) of the Education Article is repealed
because the provision has been incorporated in the revision of the Maryland
Public Ethics Law as § 15-103(b)(5) of the State Government Article.

SECTION 3. AND BE IT FURTHER ENACTED, That Section(s) 2-104(d) and
6-501(b) of Article 40A - Maryland Public Ethics Law of the Annotated Code of
Maryland be repealed and reenacted, with amendments, and transferred to the Session
Laws, to read as follows:
[2-104.] 1.

(d) Unless the appropriate advisory body otherwise decides, a person subject to
the provisions of [this article] TITLE 15 OF THE STATE GOVERNMENT ARTICLE may
rely upon a published opinion of the executive branch board of ethics, public disclosure
advisory board, any comparable local body, or any other similar or predecessor body,
unless that opinion is plainly inconsistent with the provisions of [this article] TITLE 15 OF
THE STATE GOVERNMENT ARTICLE.

REVISOR'S NOTE: This section formerly was Art. 40A, § 2-104(d).

Former Art. 40A, § 2-104(d) is not retained in the Code because it is
apparently obsolete. However, it is transferred to the Session Laws to avoid
any inadvertent substantive effect that its repeal might have.

The only changes are in style.

[6-501.] 2.

(b) Any county, the city, or municipality may ask the Commission for

modification, extension, or suspension of the time requirements of [this section] § 15-808

OF THE STATE GOVERNMENT ARTICLE to comply based upon good cause, including,
