PARRIS N. GLENDENING, Governor                                 Ch. 533

(1)      IF THE RESPONDENT IS A REGULATED LOBBYIST, FOR EACH
REPORT REQUIRED UNDER SUBTITLE 7 OF THIS TITLE THAT IS FILED LATE THE
RESPONDENT SHALL PAY A FEE OF $10 FOR EACH LATE DAY, NOT TO EXCEED A
TOTAL OF $250.

(2)      IF THE RESPONDENT IS AN OFFICIAL, FOR EACH FINANCIAL
DISCLOSURE STATEMENT FOUND TO HAVE BEEN FILED LATE, THE RESPONDENT
SHALL PAY A FEE OF $2 FOR EACH LATE DAY, NOT TO EXCEED A TOTAL OF $250.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 40A, § 2-105(d)(6) through (8).

In subsection (b) of this section, the procedure for dismissal has been
conformed to the procedure set out in § 15-403(b)(2) and (c).

15-406. JUDICIAL REVIEW - ENFORCEMENT.

(A)     JUDICIAL REVIEW.

IF THE RESPONDENT IS AGGRIEVED BY A FINAL ORDER OF THE ETHICS
COMMISSION, THE RESPONDENT MAY SEEK JUDICIAL REVIEW AS PROVIDED IN
TITLE 10, SUBTITLE 2 OF THIS ARTICLE (ADMINISTRATIVE PROCEDURE ACT —
CONTESTED CASES).

(B)     STAY PENDING JUDICIAL REVIEW.

(1)      THE ORDER IS STAYED AUTOMATICALLY UNTIL THE TIME FOR
SEEKING JUDICIAL REVIEW HAS EXPIRED.

(2)      IF A TIMELY APPEAL IS FILED, THE ORDER IS STAYED UNTIL FINAL
DISPOSITION BY THE COURT.

(C)     JUDICIAL RELIEF FOR THE ETHICS COMMISSION.

THE ETHICS COMMISSION MAY SEEK JUDICIAL ENFORCEMENT AND OTHER
RELIEF AS PROVIDED UNDER SUBTITLE 8 OF THIS TITLE.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 40A, § 2-105(d)(10) through (11).

In subsection (c) of this section, the words "enforcement and other" are added
to clarify the meaning of "seek judicial relief".
