(4)     A MEMBER WHO IS APPOINTED AFTER A TERM HAS BEGUN SERVES
FOR THE REST OF THE TERM.

(5)     AT THE END OF A TERM, A MEMBER MAY CONTINUE TO SERVE
UNTIL A SUCCESSOR IS APPOINTED AND QUALIFIES.

(E) REMOVAL.

(1)     THE GOVERNOR MAY REMOVE A MEMBER FOR:

(I)      NEGLECT OF DUTY;

(II)     MISCONDUCT IN OFFICE;

(III)   A DISABILITY THAT MAKES THE MEMBER UNABLE TO
DISCHARGE THE POWERS AND DUTIES OF OFFICE; OR

(IV)   A VIOLATION OF THIS TITLE.

(2)      BEFORE REMOVING A MEMBER, THE GOVERNOR SHALL GIVE THE
MEMBER:

(I)      WRITTEN NOTICE OF THE CHARGES; AND

(II)    AN OPPORTUNITY TO REPLY TO THE CHARGES.

REVISOR'S NOTE: Subsections (a), (b), (d)(1) and (3) through (5), and (e) of
this section are new language derived without substantive change from former
Art. 40A, § 2-102(b), (c), (e), and the first, third, and fourth sentences of (d).

In subsection (b) of this section, the word "county" is substituted for the
former words "political subdivision" for clarity.

The Ethics Law Code Revision Committee believes that there are no "political
subdivisions" in the State other than those listed in the revised text.

In subsection (b)(3)(iii) of this section, the former word "bicounty" is deleted
as included in the broader word "multicounty", which would include agencies
referred to in this title as "regional commissions".

. Subsection (c) of this section is standard language added to state the
requirement that an individual appointed to any office of profit or trust take
the oath specified in Md. Constitution, Art. I, § 9.

Subsection (d)(2) of this section is standard language substituted for the
second sentence of former Art. 40A, § 2-102(d) which provided for the terms
of the initial members and was obsolete. This substitution is not intended to

alter the term of any member of the Ethics Commission. See §__ of Ch.__,

Acts of 1995. The terms of the members serving on October 1, 1995, end as
follows: (1) 1 in 1996; (2) 1 in 1997; (3)1 in 1998; (4)1 in 1999; and (5) 1 in
2000.
