SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 48A - Insurance Code

9A.

(a)     (1) In this section the following words have the meanings indicated.

(2)     "Certificate of guarantee" means an instrument issued:

(i) By a nonprofit association of contractors, or its wholly owned
subsidiary which is approved to operate by CALVERT COUNTY, CHARLES COUNTY, ST.
MARY'S COUNTY, Prince George's [County] COUNTY, or Montgomery County, as
appropriate; and

(ii) On behalf of a contractor for the purpose of satisfying county bond
requirements for public improvements or other county bonding requirements.

(3)     "Contractor" means any person, firm, copartnership, association or
other organization that, for a fixed price, commission, fee or percentage, undertakes to
bid upon or accepts or offers to accept orders or contracts for performing or supervising
the building, construction, improvements, or maintenance of any building, structure or
road.

(b)     The provisions of this article may not be construed to apply to a certificate of
guarantee.

(c)     CHARLES COUNTY CALVERT COUNTY, CHARLES COUNTY, ST. MARY'S
COUNTY. Montgomery [County] COUNTY, and Prince George's County shall retain the
option to honor certificates of guarantee. Nothing in this article may be construed as
requiring CHARLES COUNTY CALVERT COUNTY, CHARLES COUNTY, ST. MARY'S
COUNTY, Montgomery [County] COUNTY, or Prince George's County to honor
certificates of guarantee.
