(2) A DECLARATION OF TRUST OR DEED OF TRUST TO SECURE A BAIL
BOND BY REAL ESTATE.

(C) PROVIDED ALL OTHER REQUIREMENTS OF LAW ARE FULFILLED, A
PERSON AUTHORIZED BY LAW TO TAKE A BAIL BOND SHALL TAKE A BAIL BOND
SECURED BY DECLARATION OF TRUST OR DEED OF TRUST ON REAL ESTATE
PROPERLY EXECUTED BY AN AUTHORIZED AGENT OF A PROPERTY BONDSMAN.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1995.

AN ACT concerning

Waterway Improvement Fund - Financing Construction Projects

FOR the purpose of altering the maximum amount that a certain construction project
beneficial to the boating public can cost in order to be eligible for certain financing
by the Waterway Improvement Fund; and generally relating to financing certain
construction projects by the Waterway Improvement Fund.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Natural Resources

8-708.

(a) Except as provided in § 8-708.1 of this subtitle, projects for dredging and
marking channels and harbors, construction of jetties and breakwaters, and clearing
debris, aquatic vegetation, and obstructions in navigable waters, as well as construction of
marine facilities located within lands owned by the Department and construction of
pump-out stations for use by the general boating public at public and private marinas,
shall be financed solely by the Waterway Improvement Fund. Any funds available from
the federal government, any governing body, or any gift also may be used for these
purposes.
