Ch. 397                                    1995 LAWS OF MARYLAND

(V) FAILURE TO ATTEND, WITHOUT GOOD CAUSE, AT LEAST HALF
OF THE SCHEDULED MEETINGS OF THE BOARD IN ANY ONE CALENDAR YEAR.

(2)     BEFORE REMOVING A MEMBER, THE STATE SUPERINTENDENT
SHALL SEND THE MEMBER A COPY OF THE CHARGES AGAINST THE MEMBER AND
GIVE THE MEMBER AN OPPORTUNITY WITHIN 10 DAYS TO REQUEST A HEARING.

(3) IF THE MEMBER REQUESTS A HEARING WITHIN THE 10 DAY
PERIOD;

(I) THE STATE SUPERINTENDENT SHALL PROMPTLY HOLD A
HEARING, BUT THE HEARING MAY NOT BE SET WITHIN 10 DAYS AFTER THE STATE
SUPERINTENDENT
SENDS THE MEMBER A NOTICE OF THE HEARING; AND

(II) THE MEMBER SHALL HAVE AN OPPORTUNITY TO BE HEARD
PUBLICLY BEFORE THE STATE SUPERINTENDENT IN THE MEMBER'S OWN DEFENSE,
IN PERSON, OR BY COUNSEL.

(4) A MEMBER REMOVED UNDER THIS SUBSECTION HAS THE RIGHT TO
A DE NOVO REVIEW OF THE REMOVAL BY THE CIRCUIT COURT FOR CALVERT
COUNTY.

(J) AT ITS FIRST MEETING AT THE BEGINNING OF EACH CALENDAR YEAR,
THE COUNTY BOARD SHALL ELECT A PRESIDENT AND A VICE PRESIDENT FROM
AMONG ITS MEMBERS.

(K) THE PRESIDENT OF THE COUNTY BOARD IS ENTITLED TO RECEIVE $3,000
ANNUALLY AS COMPENSATION AND THE OTHER MEMBERS ARE ENTITLED TO
RECEIVE $2,000 EACH ANNUALLY AS COMPENSATION.

(L) (1) THE COUNTY BOARD SHALL MEET AT LEAST ONCE EACH MONTH.

(2) EXCEPT FOR THOSE ACTIONS AUTHORIZED BY PARAGRAPH (3) OF
THIS SUBSECTION, ALL ACTIONS OF THE COUNTY BOARD SHALL BE TAKEN AT A
PUBLIC MEETING AND A RECORD OF THE MEETING AND ALL ACTIONS SHALL BE
MADE PUBLIC.

(3)     THE COUNTY BOARD MAY TAKE ACTIONS IN CLOSED SESSION IN
ACCORDANCE WITH
§ 10-508 OF THE STATE GOVERNMENT ARTICLE.

SECTION 4. 3. AND BE IT FURTHER ENACTED, That before Section 1, or
Section 2, or Section 3 of this Act becomes effective, each of these Sections shall first be
submitted to a special referendum of the legally qualified voters of Calvert County to be
held on September 5 November 7, 1995. The cost of the referendum, if any, shall be paid
by the Calvert County Board of County Commissioners. The Calvert County Board of
County Commissioners and the Calvert County Board of Supervisors of Elections shall do
those things necessary and proper to provide for and hold the referendum required by
this section. There shall be printed on the ballots or ballot labels to be used at this
election the title of this Act and underneath the title, on separate lines, a square or box
to the right of and opposite the words: "For a School Board Appointed by the County
Commissioners (Section 1 of this Act)"; and a corresponding square or box to the right of
and opposite the words "For a School Board Elected by the Voters of Calvert County
