Ch. 3                                       1995 LAWS OF MARYLAND

(e)     The [Superintendent] SECRETARY shall adopt rules and regulations
concerning a member's eligibility to withdraw sick leave from the Reserve including:

(1)     A requirement that the member has a long term illness and is unable to
work; and

(2)     The length of time for which a member may receive sick leave.

(f)     The [Superintendent of State Police] SECRETARY may not transfer any sick
leave under this section to a police employee who has been granted disability retirement
by the board of trustees of the State retirement systems for use after the first date on
which disability retirement may become effective.

DRAFTER'S NOTE:

Subsections (b) through (f) of this section are amended to reflect the status of
the head of the Department of State Police as the Secretary of a principal
department of State government in light of Chs. 165 and 166, Acts of 1994 and
to delete surplus language.

27.

(f) Nothing in this section shall be construed to create or recognize any cause,
action or defense or to abridge any immunity now or hereafter held by the Department,
the [Superintendent] SECRETARY or any employee.

DRAFTER'S NOTE:

Subsection (f) of this section is amended to reflect the status of the head of
the Department of State Police as the Secretary of a principal department of
State government in light of Chs. 165 and 166, Acts of 1994.

27A.

(a)     (1) The [Superintendent] SECRETARY shall charge a fee to any person
who requests that the person's fingerprints be taken.

(3)     A fee may not be charged to any person who is:

(i) Fingerprinted as a matter of procedure in any law enforcement
action;

(ii) Required to have fingerprints retaken due to any fault or error on
the part of the Department during the preparation of the fingerprint card; or

(iii) Otherwise declared by the [Superintendent] SECRETARY to be
exempt from the provisions of this section.

(b)     Subject to the provisions of the Administrative Procedure Act, the
[Superintendent] SECRETARY shall adopt rules and regulations necessary to carry out
the provisions of this section.
