Preamble

WHEREAS, As a result of the nonsubstantive revision of the pension laws that was
enacted by Chapter 6 of the Acts of 1994, a number of ambiguities or inconsistencies in
the law were noted, but could not be resolved in the nonsubstantive revision; and

WHEREAS, In addition, additional issues needing clarification have been raised by
the Board of Trustees of the State Retirement and Pension System relating to
requirements for participating employers to submit information to the Board of Trustees
and in an opinion of the Attorney General relating to early retirement provisions known
as the "16-year rule"; and

WHEREAS, It is important to clarify these statutory ambiguities and conform
inconsistent provisions that are not otherwise justified; now, therefore,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - State Personnel and Pensions

21-314.

(a) Each participating employer shall submit to the Board of Trustees a statement
that shows [:

(1) each member's] THE name, date of birth, occupational title, duties,
compensation, [and] length of service[; and

(2)] , AND OTHER information that the Board of Trustees requires regarding
employees OR FORMER EMPLOYEES of the participating employer [who are not
members].

[21-505.

(a)     A person may not knowingly make a false statement or falsify or allow another
to falsify any record of any State system in an attempt to defraud the State system.

(b)     A person who violates subsection (a) of this section is guilty of a misdemeanor
and on conviction is subject to punishment under the laws of this State.]
