14.
(a) The affairs and operations of the Department shall be supervised and directed
by a [Superintendent] SECRETARY. The [Superintendent] SECRETARY shall report to
the Governor.
(b) The [Superintendent] SECRETARY shall be appointed by the Governor by
and with the advice and consent of the Senate. The person so appointed must be a citizen.
of the United States, and qualified on the basis of training, experience, and ability to
discharge the duties of the [Superintendent] SECRETARY.
(c) The [Superintendent] SECRETARY shall serve at the pleasure of the
Governor and shall receive such salary as provided in the State budget.

This section is amended to reflect the status of the head of the Department of
State Police as the Secretary of a principal department of State government in
light of Chs. 165 and 166, Acts of 1994.
15.
(a) The [Superintendent] SECRETARY shall have the power to make any rules
necessary to promote the effective and efficient performance of the duties of the
Department and to insure the good government of the Department and its employees.
(b) In supervising and directing the affairs of the Department and in exercising
the powers referred to in the preceding subsection, the authority of the [Superintendent]
SECRETARY shall include, but shall not be limited to, the powers:
(2) To create subordinate organizational subdivisions within the
Department; to determine and define the functions, duties, and responsibilities of each
such organizational subdivision; and, from time to time, to reclassify and redefine the
functions, duties, and responsibilities of any departmental subdivision, whether created
by the [Superintendent] SECRETARY or by law;
(5) To determine and establish such ranks and grades and, in accordance
with the provisions of the State Personnel Article that govern classified service
employees, such civilian classifications as the [Superintendent] SECRETARY may deem
necessary and appropriate;
(14) To suspend, amend, rescind, abrogate or cancel any rule adopted by him
or by any former [Superintendent] SECRETARY;
(15) To grant permission to off-duty State police officers to use police
vehicles during off-duty hours, provided however, that only the officers to whom
permission has been granted may operate the vehicles, and provided that the vehicles, in
the opinion of the [Superintendent] Secretary, will not be needed by on-duty officers;
