Ch. 3
(1) Each DNA sample required to be collected under this section from
persons who are incarcerated as of October 1, 1994 or are sentenced to a term of
incarceration after that date shall be collected at the place of incarceration; and
(2) DNA samples from persons who are not sentenced to a term of
confinement shall be collected at a prison or detention facility specified by the sentencing
court.
(i) (1) The [Superintendent] SECRETARY, after consultation with the
Director, shall adopt regulations governing the procedures to be used for:
(i) Collection, submission, identification, analysis, storage, and
disposal of DNA samples; and
(ii) Access to and dissemination of typing results and personal
identification information of samples that are submitted under this section.
(k) (3) The [Superintendent] SECRETARY, after consultation with the
Director, shall adopt regulations governing the methods of obtaining information from
the Statewide DNA data base system and CODIS which shall include procedures for
verification of the identity and authority of the individual or agency requesting the
information.
DRAFTER'S NOTE:
Subsections (a)(3), (4), (6), and (9), (b)(3)(ii) and (4), (c), (g), (i)(1), and
(k)(3) of this section are amended to reflect the establishment of the
Department of State Police as a principal department of State government by
Chs. 165 and 166, Acts of 1994, to reflect the status of the head of the
Department as a Secretary of a principal department of State government,
and to delete surplus language.
Subsection (a)(11) of this section is deleted as unnecessary in light of the
definition of "Secretary" in § 2(10) of this article.

The DEPARTMENT [Maryland State Police] shall administer the laws relating to
the sales of pistols and revolvers, the licensing and supervision of private detective
agencies and certification of private detectives and security guards, the registration of
eavesdropping or wiretapping devices, and the inspection of certain classes of motor
vehicles as provided elsewhere in this Code. The DEPARTMENT [Maryland State Police]
shall perform such other duties as may be assigned from time to time by the General
Assembly.
