4-910.

(a)     (3) The application shall be in a form prescribed by the [Superintendent]
SECRETARY. It shall be accompanied by a fee of $60 to cover the costs of renewal.

(4) The [Superintendent] SECRETARY of the State Police may prescribe a
date by which applications for renewal must be submitted to the [Superintendent]
SECRETARY.

(b)     As part of the application for a commission, the applicant shall submit to the
[Superintendent] SECRETARY:

(1)     A complete set of the applicant's legible fingerprints taken on standard
fingerprint cards; and

(2)     Payment for the cost of the fingerprint card record checks.
DRAFTER'S NOTE:

Subsections (a)(3) and (4) and (b) of this section are amended to reflect the
status of the head of the Department of State Police as the Secretary of a
principal department of State government in light of Chs. 165 and 166, Acts of
1994.

4-913.

The commissions granted under this subtitle shall cease upon the filing of a notice
in writing by the State, agency, college, school system, or business which requested the
appointment, stating that the policeman is no longer required and has been relieved of his
duties. The Governor, upon recommendation by the SECRETARY OF THE State Police
[Superintendent], or on [his] THE GOVERNOR'S own motion if [he] THE GOVERNOR
finds it in the best interest of the State, may terminate any commission granted under this
subtitle. The termination shall be noted in the official records of the Governor and shall
not be effective until five days after notice is sent to the requesting State, agency, school,
or business and also to the person whose commission has been revoked. If that person
thereafter, knowing of the revocation or having in any manner received notice thereof,
exercises or attempts to exercise any of the powers granted under this subtitle, [he]
THAT PERSON shall be guilty of a misdemeanor; and upon conviction be fined not more
than $1,000 or imprisoned for not more than six months, or both. The filing and mailing
of notice as indicated above shall raise a presumption that the person knew of the
revocation.

DRAFTER'S NOTE:

This section is amended to reflect the status of the head of the Department of
State Police as the Secretary of a principal department of State government in
light of Chs. 165 and 166, Acts of 1994 and to make stylistic changes.
