Ch. 338                                    1995 LAWS OF MARYLAND

(i) To the transferor, if living; or

(ii) If the transferor is not living and died with a will, to those persons,
other than the beneficiary, designated as residuary legatees in the transferor's will in the
proportions to which they were entitled under the transferor's will; or

(iii) If the transferor is not living and died without a will, to those
persons, other than the beneficiary, who would be entitled to receive the trust property at
the time if the transferor [owning the trust property died without a will, and is] DIED
OWNING THE TRUST PROPERTY, WITHOUT A WILL, AND a resident of Maryland.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1995.

AN ACT concerning

Crimes - Cruelty to Cruel Killing of Animals

FOR the purpose of altering the penalties for torturing, cruelly beating, cruelly killing, or
intentionally starving cruelly killing, or causing, procuring, or authorizing the cruel
killing of an animal; and generally relating to the penalties for cruelty to the cruel
killing of animals.

BY repealing and reenacting, with amendments,
Article 27 - Crimes and Punishments
Section 59

Annotated Code of Maryland
(1992 Replacement Volume and 1994 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 27 - Crimes and Punishments

59.

(a) Any person who (1) overdrives, overloads, deprives of necessary sustenance,
[tortures,] OR torments [, OR cruelly beats[, or cruelly kills]; or (2) causes, procures or
authorizes these acts; or (3) having the charge or custody of an animal, either as owner or
otherwise, inflicts unnecessary suffering or pain upon the animal, or unnecessarily fails to
provide the animal with nutritious food in sufficient quantity, necessary veterinary care,
proper drink, air, space, shelter or protection from the weather; or (4) uses or permits to
