PARRIS N. GLENDENING, Governor                              Ch. 337

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 38 - Fines and Forfeitures

5.

(a) One half of the fines imposed and recognizances forfeited to the circuit court
for the several counties of the State shall be paid to the clerks of the respective courts, to
be expended under the direction of the judge or judges of said courts, for the
augmentation of the libraries of said courts. This section does not apply to Anne Arundel,
Somerset, AND Howard [and Talbot] Counties. The clerk shall retain a 5 percent
commission on the fines and forfeitures collected. In Baltimore County, this section shall
not apply to fines imposed in gambling cases.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1995.

AN ACT concerning

Maryland Discretionary Trust Act

FOR the purpose of clarifying language pertaining to termination of a trust; and generally
relating to the Maryland Discretionary Trust Act.

BY repealing and reenacting, with amendments,
Article - Estates and Trusts
Section 14-406(b)
Annotated Code of Maryland
(1991 Replacement Volume and 1994 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Estates and Trusts

14-406.

(b) Upon termination of a trust, the trustee shall transfer the unexpended trust
property:

(1)     As designated in the instrument creating the trust; or

(2)     If there is no designation, in the following order:
