PARRIS N. GLENDENING, Governor                                 Ch. 335

(I)      THE REMOVAL OF LEAD-BASED PAINT AND
LEAD-CONTAMINATED DUST, THE CONTAINMENT OR ENCAPSULATION OF
LEAD-BASED PAINT, AND THE REPLACEMENT OR REMOVAL OF LEAD-BASED
PAINTED SURFACES OR FIXTURES;

(II)     ANY ACTIVITY REQUIRED TO MEET THE RISK REDUCTION
STANDARDS SET FORTH IN § 6-815 OF THE ENVIRONMENT ARTICLE OR THE
MODIFIED RISK REDUCTION STANDARDS SET FORTH IN § 6-817 OF THE
ENVIRONMENT ARTICLE;

(III)    ANY MEASURE DESIGNED TO REDUCE TEMPORARILY HUMAN
EXPOSURE OR PROBABLE EXPOSURE TO LEAD-BASED PAINT HAZARDS, INCLUDING
SPECIALIZED CLEANING, REPAIRS, MAINTENANCE, PAINTING, TEMPORARY
CONTAINMENT, AND ONGOING MONITORING OF LEAD-BASED PAINT HAZARDS OR
POTENTIAL HAZARDS;

(IV)    ALL TESTING, PREPARATION, CLEANUP, WORKER
PROTECTION, DISPOSAL, AND POST-LEAD HAZARD REDUCTION CLEARANCE
TESTING ACTIVITIES ASSOCIATED WITH LEAD HAZARD REDUCTION ACTIVITIES;
AND

(V)     PROGRAMS DESIGNED TO TEST INNOVATIVE OR UNPROVEN
METHODS OF LEAD HAZARD REDUCTION.

(I) "LEAD HAZARD REDUCTION LOAN PROGRAM" MEANS THE LEAD
HAZARD REDUCTION LOAN PROGRAM CREATED UNDER § 2-1307(A) OF THIS
SUBTITLE.

(J) "POLITICAL SUBDIVISION" MEANS ANY MUNICIPAL CORPORATION IN
MARYLAND SUBJECT TO THE PROVISIONS OF ARTICLE XI-E OF THE MARYLAND
CONSTITUTION, THE MAYOR AND CITY COUNCIL OF BALTIMORE, AND ANY OF THE
23 COUNTIES IN MARYLAND.

THE PURPOSE OF THE LEAD HAZARD REDUCTION GRANT PROGRAM AND THE
LEAD HAZARD REDUCTION LOAN PROGRAM IS TO MAKE GRANTS AND LOANS TO
OWNERS OF RESIDENTIAL PROPERTY OR CHILD CARE CENTERS TO FUND LEAD
HAZARD REDUCTION ACTIVITIES, WITH AN EMPHASIS ON ACTIVITIES WHICH
INCLUDE THE REPLACEMENT OF WINDOWS CONTAINING LEAD-BASED PAINT ON
FRICTION SURFACES,

THE DEPARTMENT SHALL:

(1)      ADMINISTER THE PROGRAM;

(2)      ESTABLISH GUIDELINES TO DETERMINE APPLICANT ELIGIBILITY
FOR GRANTS OR LOANS; AND
