Ch. 335

(i) Must own a building in need of radon gas [,] OR asbestos [, or lead
paint] abatement, that is otherwise structurally sound or must provide a commitment
from a lender to finance necessary improvements to make the building structurally sound;
and

(ii) Must submit to the Department a proposal for the necessary
treatment which complies with the Department of the Environment requirements and
procedures for radon gas[,] OR asbestos[, or lead paint] abatement to provide a safe
environment.

(2) In addition to the requirements in paragraph (1) of this subsection, the
owner of a building:

(i) Must reside in the building and be a family of limited income;

(ii) Must rent at least two-thirds of the dwelling units in the building
to families of limited income; OR

(iii) Must provide congregate or group housing or temporary shelters to
families of limited income[; or

(iv) In the case of lead paint abatement loans, must provide services
for children, such as a licensed child day care facility, in the portion of the building to be
assisted by the loan].

[(f) (1) The Radon Gas and Asbestos Abatement Pilot Program shall be funded
in an amount not to exceed $100,000 per year, with moneys appropriated for the Lead
Paint Abatement Program as provided in § 2-313 of this subtitle.

(2) The Radon Gas and Asbestos Abatement Pilot Program shall expire on
June 30, 1990.]

SUBTITLE 13. LEAD HAZARD REDUCTION GRANT PROGRAM AND LEAD HAZARD

REDUCTION LOAN PROGRAM.

2-1301.

THE GENERAL ASSEMBLY FINDS AND DECLARES THAT:

(1)      LEAD PAINT IS PRESENT IN A LARGE PERCENTAGE OF RESIDENTIAL
PROPERTY IN MARYLAND, PARTICULARLY RESIDENTIAL RENTAL PROPERTY
CONSTRUCTED PRIOR TO 1950;

(2)      LEAD PAINT ON THE FRICTION SURFACES OF WINDOWS IS A
LEADING CAUSE OF LEAD POISONING;

(3)      LEAD POISONING CAN ADVERSELY AFFECT THE HEALTH AND
WELL-BEING OF CHILDREN AND PREGNANT WOMEN AND ENGENDERS
SUBSTANTIAL LONG-TERM PUBLIC COSTS TO PAY FOR MEDICAL EXPENSES AND
ADDITIONAL EDUCATION; AND

(4)      REDUCTION OR ELIMINATION OF LEAD IN THE ENVIRONMENT
WILL:
