AN ACT concerning
Commercial Motor Vehicle Operators - Disqualifications and Penalties
FOR the purpose of requiring a driver who is convicted of violating a certain
out-of-service order while driving a commercial motor vehicle to be disqualified for
a certain period; prohibiting an individual who has been disqualified for a certain
violation from driving a commercial motor vehicle until a certain period is
completed; defining certain terms; prohibiting certain employers from permitting a
driver to drive a commercial motor vehicle during a period when a certain
employee, vehicle or operation is subject to an out-of-service order; specifying that
certain drivers who are convicted of violating a certain order are subject to certain
civil penalties; and generally relating to the adoption of federal requirements for
disqualifications and penalties for operators of commercial motor vehicles who
violate out-of-service orders.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

16-208.1.
(a) In addition to any suspensions or revocations of an individual's license or
privilege to drive provided for in this title, if the individual holds a Class A, B, C, or D
license issued under § 16-104 of this title, the Administration shall disqualify the
individual from operating a commercial motor vehicle if the convictions resulted from an
offense involving a commercial motor vehicle and the offenses would subject the
individual to disqualification under § 16-812 of this title.
(b) Any disqualification imposed under subsection (a) of this section shall be for
the period of time provided in § 16-512 of this title.
