Ch. 86                                          1995 LAWS OF MARYLAND

Article 22 - Washington County

Title 6. [Sanitary Districts] WATER, SEWER, AND DRAINAGE SYSTEMS
6-101.

(a)      In this title the following words have the meanings indicated.

(b)     "Allocation fee" means the charge for being connected to a water or sewerage
system, including, but not limited to, an initial connection charge.

(c)      "Clerk" means the Clerk of the Circuit Court for Washington County,
Maryland.

(d)      ["Commission" means the governing body of the District, the Washington
County Sanitary Commission.

(e)] "County" means [the political subdivision of this State known as] the County
Commissioners of Washington County, [and where appropriate to the context, its elected
Board of County Commissioners] A BODY POLITIC AND CORPORATE OF THE STATE.

[(f) "District" means the body politic and corporate created under this title, the
Washington County Sanitary District.

(g)] (E) "Drainage system" means [the inlet, outfall lines, equipment, and
property for the carrying off and disposal of surface waters] ALL STRUCTURES,
CULVERTS, SYSTEMS, FACILITIES, OR PROPERTIES, EITHER MANMADE OR
NATURALLY OCCURRING, AND ALL RELATED PROPERTIES, RIGHTS, EASEMENTS,
AND FRANCHISES, DEEMED NECESSARY OR CONVENIENT BY THE COUNTY FOR THE
OPERATION OR USE IN CONNECTION WITH THE COLLECTION, CONTROL,
CONVEYANCE, OR DISCHARGE OF SURFACE WATERS, INCLUDING STORM
DRAINAGE AND STORMWATER MANAGEMENT.

[(h)](F) "Project" means a water system, sewerage system, or drainage system or
any part of these systems that the [District] COUNTY owns, constructs, or operates.

[(i)] (G) "Property" means any interest in real estate.

[(j)](H) "Regulation" means the policies that have been formally adopted and
published by the COUNTY, OR FORMERLY BY THE WASHINGTON COUNTY SANITARY
Commission.

[(k)](I) "Reserved area" means an area within a subdistrict to which the
provisions of Subtitle 3 of this title may not apply and in which property owners do not
have the right to connect to a water or sewerage system.

[(l)](J) "Roads" means public highways, streets, roads, alleys, easements, and
rights-of-way.

[(m)](K) "Sewage" has the meaning as stated in § 9-601(m) of the Environment
Article.
