appointed as chief deputy sheriff and is subsequently removed under certain
circumstances, the person may resume the employment status held prior to the
appointment to the chief deputy sheriff's position; requiring the chief deputy sheriff
to perform certain duties and functions; making certain stylistic changes; making
certain technical changes; and generally relating to the Office of the Sheriff in
Dorchester County.

BY repealing and reenacting, with amendments,
Article - Courts and Judicial Proceedings
Section 2-309(k)
Annotated Code of Maryland
(1989 Replacement Volume and 1994 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Courts and Judicial Proceedings

2-309.

(k) (1) The Sheriff of Dorchester County shall receive an annual salary of
$45,000[. The Sheriff shall] AND be allowed the actual [cost of] OPERATING COSTS OF
THE SHERIFF'S OFFICE, INCLUDING the maintenance of automobiles [and the county
jail].

(2) (I) The Sheriff shall appoint a chief deputy sheriff [, one assistant deputy
sheriff, other deputies, and a jail matron if approved by the County Commissioners. A
deputy or matron shall receive the compensation provided in the county budget].

(II)     IF AN EMPLOYEE OF THE SHERIFF'S OFFICE IS APPOINTED AS
CHIEF DEPUTY SHERIFF AND IS SUBSEQUENTLY REMOVED FROM THE CHIEF
DEPUTY SHERIFF'S POSITION FOR OTHER THAN CAUSE, THE PERSON MAY RESUME
THE EMPLOYMENT STATUS HELD PRIOR TO THE APPOINTMENT TO THE CHIEF
DEPUTY SHERIFF'S POSITION.

(III)   THE CHIEF DEPUTY SHERIFF SHALL:

1.       PERFORM ALL DUTIES ASSIGNED BY THE SHERIFF; AND

2.       IF THE SHERIFF IS TEMPORARILY INCAPACITATED OR
THERE IS A VACANCY IN THE OFFICE OF THE SHERIFF, PERFORM ALL LEGAL
FUNCTIONS OF THE SHERIFF.

[(2)] (IV) If the Sheriff becomes incapacitated and the position of chief
deputy SHERIFF is vacant, the County Commissioners shall appoint [a] AN ACTIVE
ACTING chief deputy sheriff TO SERVE UNTIL THE SHERIFF IS REACTIVATED OR
REPLACED.

(V) THE COUNTY COMMISSIONERS SHALL APPROVE THE SALARY
OF THE CHIEF DEPUTY SHERIFF.
