PARRIS N. GLENDENING, Governor

Ch. 36

(5)     THE BUSINESS IN WHICH THE APPLICANT HAS BEEN ENGAGED FOR
THE YEAR IMMEDIATELY PRECEDING THE DATE OF APPLICATION AND, IF
EMPLOYED BY ANOTHER, THE NAME AND ADDRESS OF EACH EMPLOYER; AND

(6)     ANY OTHER INFORMATION THAT THE COMMISSIONER REQUIRES
OF APPLICANTS TO ENABLE THE COMMISSIONER TO DETERMINE THE
TRUSTWORTHINESS AND COMPETENCE OF THE APPLICANT TO TRANSACT BUSINESS
AS A PUBLIC ADJUSTER SO AS TO SAFEGUARD THE INTERESTS OF THE PUBLIC.

(C) REQUIRED SIGNATURES.

AN APPLICATION SHALL BE SIGNED UNDER OATH BY:

(1)     THE APPLICANT, IF THE APPLICANT IS AN INDIVIDUAL;

(2)     EACH PARTNER OF THE PARTNERSHIP, IF THE APPLICANT IS A
PARTNERSHIP;

(3)     EACH MEMBER OF THE ASSOCIATION, IF THE APPLICANT IS AN
ASSOCIATION; OR

(4)     EACH OFFICER AND EACH DIRECTOR OF THE CORPORATION WHO IS
TO BE AUTHORIZED TO ACT AS A PUBLIC ADJUSTER, IF THE APPLICANT IS A
CORPORATION.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 48A, § 181(f), (h), and the second sentence of (d)
and, except as it related to renewal, the first sentence of (d).

In subsection (a)(1)(i) of this section, the former reference to a "written"
application is deleted as unnecessary because the application must be "on the
form that the Commissioner provides".

The Insurance Article Review Committee notes, for consideration by the
General Assembly, that the second sentence of former Art. 48A, § 170(f),
revised as subsection (b)(4) of this section, required an applicant that is an
"individual" to state whether any other insurance license or certificate has
been issued to any officer or director of the "corporation". The General
Assembly may wish to clarify this requirement.

Defined terms: "Commissioner" § 1-101
"Insurance" § 1-101
"License" § 10-401
"Public adjuster" § 10-401

10-406. ISSUANCE OF LICENSE.

(A)     IN GENERAL.

THE COMMISSIONER SHALL ISSUE A LICENSE TO EACH APPLICANT WHO MEETS
THE REQUIREMENTS OF THIS SUBTITLE.

(B)     CERTIFIED PUBLIC ADJUSTER.
