(C)  FRATERNAL BENEFIT AGENT.

"FRATERNAL BENEFIT AGENT" MEANS AN AUTHORIZED OR ACKNOWLEDGED
AGENT OF A SOCIETY THAT ACTS AS AN AGENT IN SOLICITING, NEGOTIATING,
PROCURING, OR MAKING LIFE INSURANCE, HEALTH INSURANCE, OR ANNUITY
CONTRACTS.

REVISOR'S NOTE: This subsection is new language derived without substantive
change from the introductory language of former Art. 48A, § 344B, as it
defined "insurance agent".

The term "fraternal benefit agent" is used as the defined term instead of the
former term "insurance agent" to conform to language used in Title 10,
Subtitle 1 of this article.

(D)     SOCIETY.

UNLESS THE CONTEXT REQUIRES OTHERWISE, "SOCIETY" MEANS FRATERNAL
BENEFIT SOCIETY.

change from the second sentence of former Art. 48A, § 302 and former CA §
6-401(f).

8-402. SOCIETY DEEMED FRATERNAL BENEFIT SOCIETY.

(A) IN GENERAL.

(1) AN INCORPORATED SOCIETY, ORDER, OR SUPREME LODGE
WITHOUT CAPITAL STOCK IS DEEMED TO BE A FRATERNAL BENEFIT SOCIETY IF IT:

(I)       IS CONDUCTED SOLELY FOR THE BENEFIT OF ITS MEMBERS
AND THEIR BENEFICIARIES;

(II)     IS NOT CONDUCTED FOR PROFIT;

(III) IS OPERATED ON A LODGE SYSTEM WITH RITUALISTIC FORM

OF WORK;

(IV) HAS A REPRESENTATIVE FORM OF GOVERNMENT; AND
