233. Ezekiel Fitzhue Be it remembered that the following Bill of sale Ex.d from 55 was recorded on the 27.th day of February 1850, To wit: Samuel Kirwan Know all men by these presents that I, Samuel Kirwan, of Dorchester County in the State of Maryland, for and in consideration of the sum of Twenty three dollars, current money, to me in hand paid by Ezekiel Fitzhue, of the County & State aforesaid, at and before the sealing & delivery of these presents, the receipt whereof I, the said Samuel Kirwan, do hereby acknowledge, have granted, bargained & sold, and by these presents do grant, bargain & sell, unto the said Ezekiel Fitzhue, his Executors, Administrators & Assigns, the goods & Chattels hereinafter particularly mentioned & expressed, that is to say, one Yoke of Oxen called and known by the names of Duke & Diamond, one Ox Cart, Yokes & bow which said goods & chattels are now remaining in the occupation of the said Samuel Kirwan. To have and to hold all & singular the said goods & chattels & other the premises above bargained & sold, or mentioned & intended so to be, to the said Ezekiel Fitzhue, his Executors, Administrators & Assigns, forever: And I the said Samuel Kirwan, for myself, my heirs, Executors and Administrators, all & singular the said goods & chattels, and other the premises, unto the said Ezekiel Fitzhue, his Executors, Administrators & Assigns, against me, the said Samuel Kirwan, my Executors and Administrators, and against all & every other person or persons whatsoever, shall & will warrant & forever defend by these presents; of all & singular which said goods & chattels I, the said Samuel Kirwan, have put the said Ezekiel Fitzhue in full possession, bu delivering to him, the said Ezekiel Fitzhue, the said Cart & Oxen, Yokes & bow herein described, at the sealing & delivery of these presents unto him the said Ezekiel Fitzhue as aforesaid. In Witness whereof I, the said Samuel Kirwan, have hereunto set my hand & seal this 16.th day of February in the year one thousand eight hundred & fifty. Witness James Hammersly his J. W. Hammersly Samuel x Kirwan (seal) mark State of Maryland, Dorchester County, To wit: On this 16.th day of February 1850 before me the subscriber, one of the Justices of the Peace of the said state, in & for Dorchester County, personally appears Samuel Kirwan, party to the foregoing Bill of sale, and acknowledged the said Bill of sale to be his act & deed, according to the true intent & meaning of the same: And now also at the same time and place before me, the subscriber as aforesaid, personally appears Ezekiel Fitzhue, party also to the aforegoing Bill of sale, and did make Oath on the Holy Evangely of Almighty God that the consideration mentioned in the said Bill of sale is true and bona fide as therein set forth.
