143. Certify that we are satisfied of our own knowledge that the said Samuel K. Callaway and Mary Callaway his wife, who are named & described as, and who profess to be the party Grantors in the aforegoing Deed, are the same persons who executed and acknowledged the same before us. Jos. H. Bell J. P. Jas P. Russell J. P. Reuben Tall Be it remembered that the following Mortgage Bill Ex.d from 85 of sale was recorded on the 19.th day of December 1848. Ben. B. Harrison This Indenture made this 18.th day of December in the year of Our Lord Eighteen hundred & forty eight, between Benjamin B. Harrison of Dorchester County and State of Maryland, of the one part, and Reuben Tall of said County and state of the other Whereas the said Benjamin B. Harrison owes and stands justly indebted to the said Reuben Tall in the sum of one hundred & sixty two dollars current money and to secure the payment thereof is willing to execute these presents Now this Indenture Witnesseth, that the said Benjamin B. Harrison, for and in consideration of the premises, and for and in consideration of the sum of five dollars, current money, to him in hand paid by the said Reuben Tall, at or before the sealing & delivery of these presents, the receipt whereof the said Benjamin B. Harrison doth hereby acknowledge, and thereof, and therefrom doth acquit, release, exonerate & forever discharge the said Reuben Tall, his heirs, executors & administrators, and every of them, by these presents, hath granted, bargained and sold, and by these presents doth grant, bargain & sell unto the said Reuben Tall, his heirs, executors & administrators & assigns, all and singular the following property, To wit: Letitia Simms aged twenty years, & Boy Benjamin Simms aged two years & a half To have and to hold all & singular the said Negroes Letitia & Benjamin, herein before granted, bargained & sold, or mentioned or intended so to be, unto the said Reuben Tall, his executors, Administrators & Assigns, to the only proper use & behoof of the said Reuben Tall, his executors, Administrators & Assigns forever Provided Always, and these presents are upon this condition that if the said Benjamin B. Harrison, his executors or Administrators shall and do well and truly pay or cause to be paid unto the said Reuben Tall, his executors, Administrators or Assigns the full and just sum of one hundred & sixty two dollars, current money, on or before the first day of October next, with legal interest thereon, then in such case these presents and every matter and thing herein contained shall cease, determine and be utterly void to all intents and purposes any thing contained to 1849 Octob 30 Deed del to Reuben Tall |
