142. is the property of the said Mary Callaway, wife of the said Samuel K. Callaway And Whereas the said Samuel K. Callaway and Mary his Wife have agreed to sell and convey to the said James A. Stewart & his heirs, Admr.s & Assigns forever, the said Negro Boy John as a slave for life, for and in consideration of the sum of Three hundred & thirty dollars, to them in hand paid by the said James A. Stewart, the receipt whereof they do hereby acknowledge Now this Indenture Witnesses, that for and in consideration of the Premises and of the said sum of Three hundred & thirty dollars, to them in hand paid by the said James A. Stewart, the said Samuel K. Callaway and Mary his wife have granted, bargained & sold, and by these presents do grant, bargain & sell, unto the said James A. Stewart & his heirs and Assigns forever, the said Negro boy John, aged about twenty seven years, sound in body & mind, & a slave for life. To have and to hold the said Negro Boy John, as a slave for life, to the said James A. Stewart, & his heirs & Assigns forever, and the Sheriff or Gaoler of Dorchester County is hereby directed to deliver over the said Boy John to the said James A. Stewart or his order. In Witness whereof the said Samuel K. Callaway & Mary his wife have to these presents set their hands & seals the day and year aforesaid. Signed, sealed & delivered Sam.l K. Mary x Callaway (seal) mark State of Maryland, Dorchester County, To wit: Be it remembered that on this fourteenth day of December in the year Eighteen hundred & forty eight, personally appear before us the subscribers two Justices of the Peace for said state & County Samuel K. Callaway and Mary Callaway his wife, party Grantors in the aforegoing Deed, and acknowledged the same to be their Act and deed, and the property therein mentioned to be the property of the said James A. Stewart And we further Certify that the said Mary Calloway, wife of the said Samuel K. Calloway, did sign, seal & execute the within Deed, out of the presence & hearing of her Husband; and being by us privately examined, apart from and out of the presence and hearing of her said Husband, whether she does sign, seal, execute and Acknowledge the same willingly and freely, and without being induced to do so by fear or threats of, or ill-usage by her Husband, or fear of his displeasure, Acknowledges that she does sign, seal, execute and Acknowledge the same willingly & freely, and without being induced to do so by fear or threats of, or ill-usage by her Husband, or fear of his displeasure.
