329. will warrant and forever defend by these presents of all & singular which said goods, household stuff and furniture and other the premises I the said Henry C. Elbert have put the said Algernon Hurley in full possession by delivering to him the said Algernon Hurley all of the within mentioned property at the sealing & delivering of these presents in the name of the whole premises hereby bargained & sold or mentioned or intended to be so unto him the said Algernon Hurley as aforesaid. In Witness whereof I have hereunto set my hand and seal this 1.st day of January 1846. Witness Robert Bell Henry C. Elbert (Seal) Maryland Dorchester County, To wit: on this 1.st day of January 1846 before me the subscriber one of the Justices of the Peace in and for the said County personally appeared the said Henry C. Elbert and acknowledged the foregoing instrument of writing to be his act and deed according to the the true intent and meaning thereof and the Acts of Assembly in such cases made and provided. William North Be it remembered that the following Bill of Sale was Ex.d from recorded on the 17.th day of January 1846, To Wit: James Wallace Adm.r Know all men by these presents that I James Wallace of Aaron Cook adm.r of the late Aaron Cook of Dorchester County of the State of Maryland by virtue of Authority from the Orphans Court of said County for and in consideration of the sum of one hundred and fifty dollars to me in hand paid by the said North, have granted, bargained, sold & delivered unto William North aforesaid of said County and State a Negro Woman named "Lydia" to serve the said North untill the year Eighteen hundred and fifty and then to be free & her two children the elder a Boy named "Charles" the other a Girl named Milley The said boy is now about three years of age and the Girl about three months of age The said Boy "Charles" to serve untill he is twenty six years of age and then to be free provided he is entitled to his freedom under a certain deed of manumission from the said Aaron Cook of record in the Clerks Office of said County or under the last Will & testament of the said Aaron Cook and if he be not so entitled to his freedom there to belong to the said William North as a slave for life The said Girl "Milly" also to serve untill she is twenty six years of age and then to be free provided she is entitled to her freedom under the aforesaid deed of Manumission or Will and if she is not so entitled to her freedom then to belong to the said North as a slave for life. To have and to hold the said property to the said William North, his heirs, executors, Administrators and assigns. In testimony whereof I have hereunto |
