182. instrument of Writing To wit: James Hooper & Sons Be it remembered that the following Bill of Sale from Ex.d was recorded on the 11.th day of January 1844, To wit: Thomas K. Smith This Indenture made this 11.th day of January in the Year of Our Lord one thousand eight hundred and forty four between Thomas K. Smith of Dorchester County & state of Maryland of the one part and James Hooper, John P. Hooper and James Hooper J.r of Baltimore City trading under the firm of James Hooper & Sons of the other part. Whereas Samuel M.cCollister of Dorchester County aforesaid on the twenty sixth day of November in the year eighteen hundred and forty three executed the annexed Mortgage for the consideration therein stated and whereas the said Thomas K. Smith in consideration of the sum of one hundred and seventy seven dollars and fifty eight Cents to him in hand paid by the said James Hooper, John P. Hooper & James Hooper J.r before the sealing and delivery hereof hath granted, bargained, sold, transfered, assigned and made over and by these presents doth grant, bargain, sell, assign, transfer and make over to the said James Hooper, John P. Hooper and James Hooper J.r their heirs and assigns forever the negro slaves mentioned in the said Mortgage. To have and to hold the same to them the said James Hooper, John P. Hooper & James Hooper J.r their heirs and assigns forever as fully and in as ample a Manner as the said Thomas K. Smith his heirs or assigns might hold or enjoy the same by virtue of the annexed Mortgage as aforesaid and not otherwise. And the said Thomas K. Smith doth for himself, his heirs, executors & administrators hereby authorise and empower the said Mess.rs Hoopers their heirs, executors and administrators to receive to their own use the sum of Money mentioned in the condition of the said Mortgage whenever the same shall be tendered or paid to them by the said Samuel M.cCollister his heirs, executors or administrators agreeably thereunto and to release the said annexed Mortgage upon redemption thereof as fully and to all intents and purposes as the said Thomas K. Smith his heirs executors or administrators might or could have released the same in case of such tender, payment, or redemption as if the is assignment had not been made it being the intention of this assignment to convey to the said Mess.rs Hoopers all the rights and privileges under and by virtue of the annexed Mortgage, Bill of Sale or instrument of writing which belonged to the said Thomas K. Smith before the making of this assignment. In Witness whereof the said Thomas K. Smith hath hereunto set his hand and seal the day and year in this assignment first above written The word "said" erased and the word "annexed" interlined before the execution Thomas K.
