180. and administrators shall and will warrant and forever defend by these presents to the said James Thompson his executors administrators and assigns the said described property against me my executors & administrators and against all & every other person or persons claiming the same or any part thereof. Dorchester County To wit: on this 30.th day of December 1843 before me the subscriber a Justice of the Peace for said County personally appeared Elisha Phillips and acknowledged the aforegoing instrument to be his act and deed according to the true intent and meaning thereof and the acts of Assembly in such case made and provided. Smith Be it remembered that the following Mortgage Bill from Ex.d of Sale was recorded on the 12.th day of December 1843 Samuel M.cCollister To wit: This Indenture made this twenty sixth day of November in the year of our Lord one thousand eight hundred and forty three between Samuel M.cCollister of Dorchester County State of Maryland of the one part and Thomas K. Smith of the County and state aforesaid of the other part Whereas the said Samuel M.cCollister owes and stands justly indebted to the said Thomas K. Smith in the sum of one hundred and eighty eight dollars current money and to secure the payment thereof is willing to execute these presents. Now this Indenture Witnesseth that the said Samuel M.cCollister for and in consideration of the Premises and of the sum of five dollars current money to him in hand paid by the said Thomas K. Smith at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged hath granted, bargained and sold and by these presents doth grant bargain and sell unto the said Thomas K. Smith his executors, administrators and assigns all and singular the Negroes hereinafter particularly mentioned and expressed that is to say one Negro Woman named Louisa and her child named Sarah Jane. To have and to hold all and singular the said Negroes unto the said Thomas K. Smith his executors administrators and assigns to his and their own use and behoof; Provided Always and it is declared to be the true intent and meaning of these presents that if the said Samuel McCollister do and and shall well and truly pay or cause to be paid unto the said Thomas K. Smith his executors administrators or assigns the full sum of one hundred and ninety three dollars current money with legal interest for the same on or before the first day of November in the year of Our Lord one thousand eight hundred and forty four then and in such case Del.d D L Goldsborough 13 March 1845 |
