138 to have & to hold all & singular the said goods or property unto said Hooper C Hicks his administrators or assigns to his and his own use and behoof Provided always and it is declared to be the true intent and meaning of these presents that if the said John H Carroll do and shall well and truly pay or cause to be paid unto said Hooper C Hicks his executors or assigns the full sum of Four Hundred Dollars Current money with interest for the same on or before the 21st day of June Eighteen Hundred & forty three then and in such case these presents and every matter and thing herein Contained shall cease determine and be utterly void to all intents and purposes any thing herein contained to the contrary notwithstanding And the said Jno H Carroll for himself promises to pay to Hooper C Hicks the full and just sum of Four Hundred Dollars Current money with interest and in case the said John H Carroll does not pay the above named sum to Hooper C Hicks on or before the 21st day of June Eighteen Hundred & forty three by these presents bargained and sold and every part thereof to Hooper C Hicks his administrators or assigns and against all and every other person or persons whatsoever shall and will warrant and defend by these presents As witness whereof I hereunto set my hand and seal the day & year heretofore mentioned Signed sealed & delivered in presents of John H Carroll (Seal) John G Abbott Maryland Dorchester To wit On this 19 Day of June 1843 personally appeared John H Carroll before me the subscriber one of the Justices of the peace and acknowledges the foregoing Riting To be his act and Deed according to the true intent & meaning of the same and the act of assembly in such case made & provided John G Abbott: J.P. Thomas Esgate Be it remembered that the following bill of sale was recorded Ex.d from 23d June 1843 to wit Know all men by these presents Edward Willey that I Edward Willy of Dorchester County in the state of Maryland for and in consideration of the sum of seventy five dollars current money to me in hand paid by THomas Esgate of said County and shall stand before the sealing and delivery of these presents the receipt whereof I the said Edward Willy do hereby acknowledge have granted bargained and sold and by these presents do grant bargain and sell unto the said Thomas Esgate his heirs or assigns all the Crop of wheat and Corn now on the ground at the worlds and where I now live to have and to hold the said Crop of wheat and Corn above bargained and sold to the said Thomas Esgate his heirs and assigns forever In witness whereof I the said Edward Willy have hereunto set my hand and seal this 20th day of June 1843 Signed Sealed and delivered in the presence of Edward Willey (seal) Henry Shenton Maryland Dorchester County to wit on this 20th day of June 1843 |
