Ch. 6                                       1994 LAWS OF MARYLAND

(4)     The person returns to the Board of Trustees the accumulated
contributions together with the interest previously refunded;

(5)     The person pays to the Board of Trustees any appreciation or earnings
in the person's Individual Retirement Account and other amounts that the Board
determines; and

(6)     The person satisfies any and all additional eligibility criteria established
by the Board of Trustees.

(b) A person described in subsection (a)(1), (2), and (3) of this section or the
beneficiary of such a person may elect to participate in the Teachers' Retirement System
of the State of Maryland upon such terms and conditions as the Board of Trustees shall
determine.

REVISOR'S NOTE: This section formerly was Art. 73B, § 3-206.

Former § 3-206 is not retained in the Code because, as it related to
membership in the Teachers' Retirement System, it is apparently obsolete
because the system is closed to new members. However, it is transferred to the
Session Laws to avoid any inadvertent substantive effect that its repeal might
have.

The only changes are in style.

SECTION 7. AND BE IT FURTHER ENACTED, That Section(s) 2-410 of
Article 73B - Pensions of the Annotated Code of Maryland be repealed and reenacted,
with amendments, and transferred to the Session Laws, to read as follows:

MEMBERS OF THE GENERAL ASSEMBLY

[2-410.] 1.

A person appointed or elected to the General Assembly on or after January 1-; 1971
may participate in the pension plan provided in resolution of the General Assembly
Compensation Commission under Article III, § 15 of the Maryland Constitution.

REVISOR'S NOTE: This section formerly was Art. 73B, § 2-410.

Former § 2-410 is not retained in the Code because, as it related to members
of the General Assembly, it is apparently unnecessary because the resolution
of the General Assembly Compensation Committee authorizes members of
the General Assembly to participate in the pension plan provided in the
resolution. However, it is transferred to the Session Laws to avoid any
inadvertent substantive effect that its repeal might have.

No changes are made.

SECTION 8. AND BE IT FURTHER ENACTED, That Section(s) 3-501 through
3-505, inclusive, and 3-506(a), (b)(2), and (c)(2) and (3) of Article 73B - Pensions of the
Annotated Code of Maryland be repealed and reenacted, with amendments, and
transferred to the Session Laws, to read as follows:
