Ch. 6                                            1994 LAWS OF MARYLAND

"WITHDRAWAL DATE" MEANS THE DATE THAT A WITHDRAWAL BY A
PARTICIPATING GOVERNMENTAL UNIT FROM THE EMPLOYEES' SYSTEMS OR THE
LOCAL FIRE AND POLICE SYSTEM TAKES EFFECT.

REVISOR'S NOTE: This subsection is new language added to avoid the repetition
of the lengthy reference to "the date that a withdrawal by a participating
governmental unit from the employees' systems or the Local Fire and Police
System takes effect".

31-302. WITHDRAWAL GENERALLY.

(A)     WITHDRAWAL FROM AN EMPLOYEES' SYSTEM.

THE LEGISLATIVE BODY OF A PARTICIPATING GOVERNMENTAL UNIT MAY
WITHDRAW FROM PARTICIPATION IN THE EMPLOYEES' SYSTEMS AND TRANSFER TO
A LOCAL PENSION SYSTEM ANY OF THE FOLLOWING GROUPS OF EMPLOYEES OF
THE GOVERNMENTAL UNIT WHO CONSENT TO THE WITHDRAWAL:

(1)      ALL EMPLOYEES OF THE PARTICIPATING GOVERNMENTAL UNIT;

(2)      FIRE FIGHTERS;

(3) LAW ENFORCEMENT PERSONNEL; OR

(4) SUBJECT TO THE APPROVAL OF THE BOARD OF TRUSTEES, A
HOMOGENEOUS UNIT OF AT LEAST 10' EMPLOYEES.

(B)      WITHDRAWAL FROM THE LOCAL FIRE AND POLICE SYSTEM.

            THE LEGISLATIVE BODY OF A PARTICIPATING GOVERNMENTAL UNIT MAY
WITHDRAW FROM PARTICIPATION IN THE LOCAL FIRE AND POLICE SYSTEM AND
TRANSFER TO A LOCAL PENSION SYSTEM THE LAW ENFORCEMENT OFFICERS OR
FIRE FIGHTERS OF THE PARTICIPATING GOVERNMENTAL UNIT WHO CONSENT TO
THE WITHDRAWAL.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 73B, §§ 10-106(a)(2) and 10-229(j).

In this section and throughout this subtitle, explicit provisions on withdrawal
from the Local Fire and Police System are substituted for the cross-reference
to the provisions on withdrawal from the employees' systems in former Art.
73B, § 10-229(j), for clarity.
