1994 LAWS OF MARYLAND

(1)      THE MEMBER'S AVERAGE FINAL COMPENSATION; OR

(2)      THE SUM OF:

(I)       AN ANNUITY THAT IS THE ACTUARIAL EQUIVALENT OF THE
MEMBER'S ACCUMULATED CONTRIBUTIONS AT RETIREMENT; AND

(II)     A PENSION EQUAL TO TWO-THIRDS OF THE MEMBER'S
AVERAGE FINAL COMPENSATION.

(C) EXCEPTION.

(1) THIS SUBSECTION APPLIES TO A MEMBER OF A STATE SYSTEM
OTHER. THAN THE NATURAL RESOURCES PENSION SYSTEM WHO IS AT LEAST
NORMAL RETIREMENT AGE.

(2) AN ACCIDENTAL DISABILITY RETIREMENT ALLOWANCE EQUALS
THE GREATER OF:

               (I) A NORMAL SERVICE RETIREMENT ALLOWANCE; OR

(II) AN ACCIDENTAL DISABILITY RETIREMENT ALLOWANCE
COMPUTED IN ACCORDANCE WITH SUBSECTION (B) OF THIS SECTION.

REVISOR'S NOTE: Subsection (a) of this section is new language added for
clarity.

Subsections (b) and (c) of this section are new language derived without
substantive change from former Art. 73B, §§ 2-404(b)(2), 3-404(b)(2),
4-404(b)(4), 5-404(b)(4), 7-404(b)(2), 8-402(b)(4), and 10-218(d).

29-111. SPECIAL DISABILITY RETIREMENT — STATE POLICE RETIREMENT SYSTEM.

(A)     SCOPE OF SECTION.

THIS SECTION APPLIES TO THE STATE POLICE RETIREMENT SYSTEM.

(B)      ELIGIBILITY.

. THE BOARD OF TRUSTEES SHALL GRANT A SPECIAL DISABILITY RETIREMENT
ALLOWANCE TO A MEMBER IF:
