28-102. LEGISLATIVE POLICY.

EXCEPT AS OTHERWISE PROVIDED IN THIS TITLE, THE OPERATION OF THE
LOCAL FIRE AND POLICE SYSTEM SHALL BE THE SAME AS THE OPERATION OF THE
EMPLOYEES' PENSION SYSTEM.

REVISOR'S NOTE: This section formerly was the second sentence of Art. 73B,
§ 10-203.

The only changes are in style:

The State Personnel and Pensions Article Review Committee notes, for the
consideration of the General Assembly, that the second sentence of former
Art. 73B, § 10-203 has been retained though its usefulness is now
questionable. When this section was originally, enacted, the law on the Local
Fire and Police System was cursory; however, the law on the Local Fire and
Police System has been expanded in recent years, thus making this section
seem unnecessary. The General Assembly may want to consider its repeal.

The first sentence of former Art. 73B, § 10-203 is deleted as unnecessary in
light of § 21-108 of this article.

SUBTITLE 2. MEMBERSHIP.

28-201. MEMBERSHIP IN THE LOCAL FIRE AND POLICE SYSTEM — SCOPE.

THIS SUBTITLE APPLIES ONLY TO AN EMPLOYEE OF A PARTICIPATING
GOVERNMENTAL UNIT WHO IS:

(1) A LAW ENFORCEMENT OFFICER AS DEFINED IN § 31-201 OF THIS
ARTICLE; OR

(2) A FIRE FIGHTER AS DEFINED. IN § 31-201 OF THIS ARTICLE.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 73B, §§ 10-201(e) and (f) and, as it described the
scope of the Local Fire and Police System, 10-206(a).
