GENERAL REVISOR'S NOTE TO TITLE: Throughout this title references to
"member" are substituted for former references to "judge" to reflect that
"judge" is no longer a defined term. Former Art. 73B, § 9-101(e), which
defined "judge" is revised in § 27-201 as a scope provision for the subtitle on
membership. See Revisor's Note to § 27-201 of this title. Similarly the
references to "former member" or "retiree" are substituted for the former
reference to "former judge" or "retired judge" as appropriate. Also, the use of
the defined terms "member", "former member", and "retiree" conforms the
provisions in this title to similar provisions in this Division II.
Former Art. 73B, § 9-206, which applied only to court stenographers in the
five counties that comprise the second judicial circuit and required the
counties to pay a pension to those who serve at least 25 years, is transferred to
CJ, § 2-501(d).
Former Art. 73B, § 9-106, which related to the noncontributory plan of the
Judges' Retirement Plan, is transferred to the Session Laws. There are no
members who participate in the noncontributory plan, so this section is only
applicable to those who have retired and are still receiving a retirement
allowance. Former Art. 73B, §§ 9-101 and 9-104, which related to both the
noncontributory plan and contributory plan, are also transferred to the
Session Laws to the extent that they apply to the noncontributory plan.
Former Art. 73B, §§ 9-201 through 9-205, which related to pensions for
former judges of the Municipal Court of Baltimore City, the People's Court of
Anne Arundel County, Montgomery County, and Prince George's County, and
to the former trial magistrates of Calvert County, are transferred to the
Session Laws. These sections are limited and now only affect a few retirees.
