In subsection (a) of this section, the term "eligibility service" is substituted for
"[m]embership service" and the types of credit listed in former Art. 73B, §
7-301(a)(2)(i) and (iii) through (v) because those types of service credit equal
eligibility service under § 25-303 of this subtitle, except as provided in
subsection (b) of this section.

In subsection (b) of this section, the reference to "creditable service" is
substituted for the former reference to "the actual time served" for clarity and
to reflect the use of the defined term "creditable service".

Also in subsection (b) of this section, the former references to "part-time
service" allowed "by the medical board" and the references to a member who
makes "the contributions for full-time employment" are deleted as inaccurate.
The State Personnel and Pensions Article Review Committee determined that
this provision, which appears in § 22-309(b), was inadvertently duplicated in
this title by Ch. 131, Acts of 1992. The Department of Public Safety and
Correctional Services concurs with this interpretation.

SUBTITLE 4. SERVICE RETIREMENT BENEFITS.

25-401. NORMAL SERVICE RETIREMENT.

(A)     AGE AND SERVICE REQUIREMENTS — RETIREMENT AT MEMBER'S
OPTION.

A MEMBER MAY RETIRE WITH A NORMAL SERVICE RETIREMENT ALLOWANCE
IF:

(1)      ON OR BEFORE THE DATE OF RETIREMENT, THE MEMBER HAS AT
LEAST 20 YEARS OF ELIGIBILITY SERVICE;

(2)      FOR AT LEAST 5 YEARS IMMEDIATELY BEFORE RETIREMENT, THE
MEMBER WAS A SECURITY ATTENDANT AT CLIFTON T. PERKINS HOSPITAL CENTER,
A CORRECTIONAL OFFICER IN ANY OF THE FIRST SIX JOB CLASSIFICATIONS, OR IN A
COMBINATION OF THESE POSITIONS; AND

(3)      THE MEMBER COMPLETES AND SUBMITS A WRITTEN APPLICATION
TO THE BOARD OF TRUSTEES STATING THE DATE WHEN THE MEMBER DESIRES TO
RETIRE.

(B)     COMPUTATION OF NORMAL SERVICE RETIREMENT ALLOWANCE.

ON RETIREMENT UNDER THIS SECTION, A MEMBER IS ENTITLED TO RECEIVE A
NORMAL SERVICE RETIREMENT ALLOWANCE THAT EQUALS ONE FIFTY-FIFTH OF
THE MEMBER'S AVERAGE FINAL COMPENSATION MULTIPLIED BY THE NUMBER OF
YEARS OF CREDITABLE SERVICE.
